Terms and Conditions of Use 1. Acceptance of Terms of Service 1.1 By using or accessing this website, you agree to be bound by, confirm that you are fully able and competent to comply with and understand:
(i) these terms and conditions (the Terms of Service)
(ii) ReDress Styling's terms of business set out at clause 3 (Terms of Business) and
(iii) ReDress Styling's privacy policy (which is incorporated herein by reference and which can be viewed at www.redress-styling.co.uk (the Privacy Policy).
Please read these Terms of Service carefully. If you do not agree to any of the terms in these Terms of Service (which includes, for the avoidance of doubt, the Privacy Policy), then you may not use and should immediately cease accessing the Website.
1.2 ReDress Styling (also referred to herein as we, our or us) may, in its sole discretion, revise or modify these Terms of Service and/or the Terms of Business from time to time, and may modify, suspend or terminate the Website at any time and without notice. By continuing to use or access the Website, you agree to be bound by, and your use of this Website and any transaction shall be governed by, the Terms of Service and Terms of Business in effect at the time of such use or access including any modifications or revisions thereto.
2. ReDress Styling Website 2.1 The Website enables users to browse information and book services.
2.2 The Website may contain links to third party websites that we do not own or control. We cannot censor or control the content of such third party websites and as such accept no responsibility or liability for the content, terms and conditions of use, privacy policy or practices of such websites. In using this Website, you expressly agree that we shall not be held liable for any liability whats oever resulting from or in connection with your use of such third party websites.
2.3 Whilst the Website will normally be available, there will be occasions when the availability of the Website will be interrupted for scheduled maintenance or upgrades, emergency repairs, or due to failure of telecommunications links and equipment that are beyond our control.
3. Terms of Business3.1 In the event that you commission any services from ReDress Styling whether via the Website or otherwise, you will receive an email confirming the scope of those services and details of the fee (the Quote).
3.2 Such fee will become due and payable within seven days of your acceptance of the Quote described in clause 3.1 above. Interest on late payments will be charged at the statutory rate, payable on judgment debts.
3.3 If the Quote relates to a package of products or services the fee payable relates to the package as a whole and may not be broken down into several payments in respect of the constituent parts.
3.4 Following your acceptance of the Quote, any subsequent cancellation shall result in the following sums being payable:
(a) Cancellation within 24 hours of commencement of performance of the services: fee payable in full
(b)Cancellation within 72 hours of commencement of performance of services: 50% of fee payable.
3.5 Any vouchers for ReDress Styling services must be used within six months of the date of purchase. Please note that the minimum value of any service against which vouchers may be redeemed is £35.
3.6 As a precondition to ReDress Styling providing services to you, you will be asked to respond to a questionnaire and submit certain personal information. ReDress Styling shall keep such information confidential and shall observe the provisions of relevant data protection legislation.
4. Disclaimer of WarrantyYou acknowledge and agree that your use of the Website shall be at your sole risk. To the fullest extent permitted by law, ReDress Styling, its officers, directors, employees and agents disclaim all warranties, express or implied, in connection with the Website and your use there of. Without limiting the foregoing, ReDress Styling makes no representations or warranties about the accuracy or completeness of the information, on this Website, or the content of, or products or services advertised or offered by a third party through, any websites linked to this Website or featured in any banner or other advertising. ReDress Styling assumes no liability or responsibility any viruses, bugs, Trojan horses or the like which may be transmitted through or to the Website by any third party.
5. Limitation of liabilityIn no event will ReDress Styling, its officers or employees be liable to you or any third party for any direct, indirect, special, punitive or consequential damages (including but not limited to Website unavailability and interruptions, loss of data, computer failure or pecuniary loss) arising out of your use of the Website whether based on contract, warranty, tort (including negligence), product liability, strict liability or any other legal theory, whether or not ReDress Styling has been advised of the possibility of such damages. This limitation of liability shall apply to the fullest extent permitted by law in the applicable jurisdiction. 6. IndemnityYou agree to defend, indemnify and hold harmless ReDress Styling and its officers, employees and agents from and against any claims, damages, liabilities, losses and expenses (including, without limitation, reasonable legal and accounting fees) arising out of or in connection with
(i) your access to or use of the Website;
(ii) any products or services provided to you by ReDress Styling; or
(iii) your breach of any of these Terms of Service. We reserve the right to assume exclusive control (at our cost) over the conduct of any such claim or the defence thereto, in which event you will cooperate in full with ReDress Styling in this regard. 7. Assignment These Terms of Service, and any rights and licences granted and obligations imposed hereunder, may not be transferred, sub-licensed or assigned by you. We may freely assign or license any of the rights and licences granted, and obligations imposed, hereunder. 8. Law and jurisdiction This Website shall be deemed to be solely based in England. These Terms of Service will be governed by and construed in accordance with the laws of England and Wales, without regard to conflicts of law rules. You expressly agree that the English Courts have exclusive jurisdiction over any claim or action arising out of or relating to these Terms of Service or your use of the Website. 9. General ReDress Stylings failure at any time to require performance of any provision hereof shall in no manner affect its right at a later time to enforce the same unless the same is waived in writing. If any provision of these Terms of Service is deemed invalid by a court of competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Service, which shall remain in full force and effect. The headings in these Terms of Service are for convenience only and shall not affect the construction or interpretation of these Terms of Service. These Terms of Service, together with our Privacy Policy and the terms of any confirmatory email as described in clause 3.1, shall constitute the entire agreement between you and concerning this Website and supersedes all prior and contemporaneous agreements or understandings relating to such subject matter.
